The agreement between Schmeitzke, operator of Summa, and the individual consumer creating or using a personal account.
1. Parties and eligibility
These Consumer Terms are an agreement between Schmeitzke, operator of Summa, and the individual consumer creating or using a personal account. A "consumer" is a natural person acting outside their trade, business, craft or profession.
You must be at least 18 years old, have legal capacity, provide accurate account information, and use the service in accordance with these Terms and the Acceptable Use Policy. Accounts are personal and may not be transferred or shared.
2. The service and AI disclosure
Summa provides access to an artificial-intelligence chat service and related account, history, export and subscription functionality described on the order page. Available models, limits and features may change; we will not materially reduce a paid service during a current paid period without a valid reason and appropriate notice.
- You are interacting with an AI system; responses are generated by a machine.
- AI output may be inaccurate, incomplete, outdated, biased or unsuitable, and requires human review.
- Summa is not a substitute for a qualified medical, legal, financial, safety or other regulated professional.
- Summa may apply automated safety controls, and exported content may include machine-readable information identifying it as AI-generated.
3. Your content and model training
You retain the rights you hold in prompts and other content you submit. You grant Summa a limited, non-exclusive right to host, transmit, reproduce and technically process that content solely to provide the service, maintain security, comply with law, investigate reported misuse, and exercise or defend legal claims. This licence ends when the content is deleted, except for lawful residual retention.
Summa does not use personal-account conversations to train or fine-tune the general Summa model unless it first obtains a separate, explicit and informed agreement. Aggregated or effectively anonymised operational statistics may be used to measure and improve reliability.
4. Acceptable use and limits
The Acceptable Use Policy forms part of these Terms. You may not use the service for unlawful, harmful, deceptive, abusive, infringing or security-compromising activity, and may not attempt to bypass technical limits or safety controls.
Plans may include message/token, context, storage, generation-length, concurrency and fair-use limits shown before purchase or in the account interface. Automated extraction, resale, account sharing and programmatic use are prohibited unless expressly included in the selected plan.
5. Prices, payment, duration and renewal
The order page states the total consumer price including VAT, the billing period, the principal features and limits, whether the subscription renews automatically, and how it may be cancelled. Payment is processed by Stripe or another disclosed provider. Subscriptions are charged in advance; a failed payment may lead to suspension after reasonable notice.
Unless the order page states otherwise, a paid personal subscription has a monthly billing period and renews automatically until cancelled. You may cancel online through the billing settings; cancellation ordinarily takes effect at the end of the current paid period. After any fixed initial term, an automatically continued subscription may be cancelled subject to no more than the legally permitted notice period.
6. Statutory withdrawal right
A consumer who concludes the agreement online normally has 14 days from conclusion of the agreement to withdraw without giving a reason. The account and checkout interface provide a withdrawal function during this period. You may also send an unambiguous withdrawal statement to info@summalabs.ai.
Where you expressly request that the service begin during the withdrawal period, you may owe a proportionate amount for service already supplied if you later withdraw, to the extent permitted by law. Any waiver or loss of a withdrawal right applies only where the statutory requirements have been met and separately confirmed. Ordinary use of the service does not, by itself, remove a statutory right.
7. Conformity and statutory remedies
Nothing in these Terms limits mandatory consumer rights. Summa must provide a digital service that conforms to the agreement and to reasonable consumer expectations, including applicable security updates. Where the service is non-conforming, you may be entitled to correction within a reasonable period and without charge, an appropriate price reduction, termination, a refund, and retrieval of eligible user-provided digital content.
Contact info@summalabs.ai and describe the problem. We may request proportionate cooperation to investigate the relevant device or environment, provided this causes minimal inconvenience.
8. Changes, suspension and termination
We may change the service where reasonably necessary to maintain security, comply with law, improve or adapt the service, replace discontinued technology, prevent abuse, or protect users. Where a change materially and negatively affects a paid service, we will provide reasonable advance notice and any termination right required by law.
We may suspend access where reasonably necessary because of an immediate security threat, unlawful or prohibited use, material breach, non-payment, risk to other users, or binding legal requirements. You may stop using the free service and request account deletion at any time. Cancelling billing does not automatically delete workspace data, and deleting an account does not remove legally required billing records.
9. Availability and liability
We aim to provide a secure and reliable service but do not promise uninterrupted availability. Beta or preview functionality is identified as such and may have lower availability or durability. Paid production subscriptions will not be marketed as durable storage unless the applicable service description expressly says so.
Nothing in these Terms excludes liability where exclusion is prohibited, including for intentional conduct, death or personal injury caused by negligence, or mandatory consumer and data-protection rights. Subject to mandatory law, Summa is responsible for direct, foreseeable loss caused by an attributable breach, but not for a user’s decision to rely on unverified AI output, loss caused by prohibited use or credential mishandling, or indirect or unforeseeable loss.
10. Complaints, governing law and courts
Complaints may be submitted to info@summalabs.ai. We aim to acknowledge within five business days and respond substantively within fourteen days where reasonably possible. Dutch law applies; this does not deprive an EU consumer of mandatory protection under the law of their habitual residence. A consumer may bring proceedings before a court that has jurisdiction under applicable consumer law.
